Seller Agreement

Welcome to Pacific Hypermart (the “Platform”). This Seller Agreement (the “Agreement”) sets forth the terms and conditions governing your use of the Platform as a seller of goods or services. By using the Platform as a seller, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms and conditions of this Agreement, you may not use the Platform as a seller.

Terms & Conditions:

  1. Seller Obligations: As a seller on the Platform, you agree to:
    1. Comply with all applicable laws and regulations regarding the sale and delivery of goods or services.
    2. Not solicit buyers to complete transactions outside of the Platform.
    3. Not sell any items listed in the prohibited items category. Please see annexure-I
    4. Provide accurate and complete information about your products or services, including pricing, availability, and shipping or delivery times.
    5. Fulfill all orders placed by buyers in a timely and professional manner, including providing accurate tracking information and addressing any issues or complaints promptly.
    6. Maintain the quality and authenticity of your products or services, and respond promptly to any requests for refunds or returns.
    7. Not engage in any fraudulent or illegal activities, including the sale of counterfeit goods, pirated software or media, or any other infringing materials.
  2. Platform Fees: As a seller on the Platform, you agree to pay any applicable fees for using the Platform. These fees may be deducted from your sales revenue, or you may be required to pay them directly to the Platform.
  3. Intellectual Property: You retain all ownership and rights to any intellectual property associated with your products or services. By using the Platform as a seller, you grant the Platform a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your product or service information for the purpose of promoting and facilitating the sale of your products or services on the Platform.
  4. Return and Refund. In the event of a dissatisfied customer, you agree to accept the return within 30 days of sale, and refund the amount. The platform will initiate the refund on your behalf.
  5. Termination: This Agreement may be terminated by either party at any time, for any reason or no reason. If your account is terminated, you will no longer be able to sell on the Platform and any pending orders will be canceled.
  6. Limitation of Liability: The Platform is not responsible for any damages or losses incurred as a result of your use of the Platform as a seller, including but not limited to any direct or indirect damages, lost profits, or reputational harm. The Platform is not responsible for any disputes between buyers and sellers, and you agree to indemnify and hold the Platform harmless from any claims or damages arising from your use of the Platform as a seller.
  7. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of State of Washington. Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of state of Washington.

Annexure – I

Prohibited Items Categories:

  1. Illegal or counterfeit items: This includes items that infringe on intellectual property rights, such as counterfeit goods or pirated software, as well as items that are illegal to sell or possess, such as drugs or weapons.
  2. Restricted or regulated items: This includes items that are subject to certain regulations or restrictions, such as firearms, ammunition, hazardous materials, or certain types of food or medical products.
  3. Tobacco products and intoxicants used for recreation purpose
  4. Alcoholic Beverages
  5. Objects of Worship
  6. Offensive or inappropriate items: This includes items that are considered offensive, harmful, or inappropriate, such as hate speech, pornography, or items that promote violence or discrimination.
  7. Stolen or fraudulent items: This includes items that are stolen, fraudulent, or otherwise obtained illegally, such as stolen goods, fake IDs, or stolen credit card information.
  8. Dangerous or hazardous items: This includes items that are inherently dangerous or hazardous, such as fireworks, explosives, or chemicals.
