Buyer Agreement
Welcome to Pacific Hypermart (the “Platform”). This Customer / Buyer Agreement (the “Agreement”) sets forth the terms and conditions governing your use of the Platform as a buyer of goods or services. By using the Platform as a buyer, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms and conditions of this Agreement, you may not use the Platform as a buyer.

Buyer Obligations: As a buyer on the Platform, you agree to:

  1. Provide accurate and complete information when placing orders, including shipping or delivery information and payment information.
  2. Pay for any products or services ordered in a timely and appropriate manner, and not engage in any fraudulent or illegal activities.
  3. Comply with all applicable laws and regulations regarding the purchase and use of products or services.
  4. Review and accept the terms and conditions of each transaction before completing your purchase.
  5. Not engage in any activity that may disrupt or interfere with the operation of the Platform, including but not limited to hacking, spamming, or other malicious activity.
  6. Not engage in any activity that may harm the reputation or business of the Platform or its sellers.
  7. Payment: As a buyer on the Platform, you agree to pay the listed price for any products or services ordered, as well as any applicable taxes, shipping or delivery fees, or other charges associated with the purchase. Payment may be processed through the Platform or through a third-party payment provider.
  8. Shipping and Delivery: Shipping and delivery of products or services will be governed by the terms and conditions established by the seller. The Platform is not responsible for any delays, damages, or other issues related to shipping or delivery, and you agree to hold the seller responsible for any such issues.
  9. Returns and Refunds: Returns and refunds of products or services will be governed by refund policy.
  10. Dispute Resolution: Any disputes between buyers and sellers will be resolved by the parties involved, and the Platform will not be responsible for any such disputes. In the event of a dispute, you agree to notify the seller and attempt to resolve the issue in good faith.
  11. Limitation of Liability: The Platform is not responsible for any damages or losses incurred as a result of your use of the Platform as a buyer, including but not limited to any direct or indirect damages, lost profits, or reputational harm. The Platform is not responsible for any disputes between buyers and sellers, and you agree to indemnify and hold the Platform harmless from any claims or damages arising from your use of the Platform as a buyer.
  12. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of State of Washington. Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of the State of Washington.
